Overtime pay and night shift pay—things we think we understand, but actually don’t.
First, let's calculate your hourly wage.
If you want a more accurate estimate, it would be best to use long-term data, such as the number of workdays in a year or overtime hours.
That gives us the hourly wage, right?
And here are the laws regarding night shifts.
Article 37, Paragraph 4 of the Labor Standards Act
If an employer causes an employee to work between 10:00 p.m. and 5:00 a.m. (or, in cases where the Minister of Health, Labor, and Welfare deems it necessary, between 11:00 p.m. and 6:00 a.m. in regions or during periods specified by the Minister), the employer must pay premium wages for work performed during those hours at a rate of not less than 25 percent of the amount calculated based on the regular hourly wage.
Basically, if you work a night shift,
This means that the law stipulates that you must be paid at least 1.25 times your hourly wage between 10:00 p.m. and 5:00 a.m.
It's a rough outline, but this is what it looks like.
So, first, calculate your hourly wage.
Next, please calculate your night shift hours.
However, the rules regarding overtime work may vary depending on the type of employment contract you have.
If you work a night shift and this provision is not included, there is a possibility that it could constitute a violation of labor standards.
